- You must be **13 or older**.
- If you are under the age of majority in your region, a parent or guardian must accept these Terms for you.
- You may use the Service on behalf of an organization only if you have authority to bind that organization. “You” includes that organization.
- Some features require an account using email, Apple, or Google. Keep your credentials secure. You are responsible for activity on your account.

- You can buy increased participant capacity for a film. Prices and taxes are shown in‑app.
- For iOS and Android, payments are processed by **Apple** or **Google**. Their terms and refund rules apply.
- All purchases are **final** except where required by law or when a technical issue we control prevents use. Email [**hello@once.film**](mailto:hello@once.film) within **14 days** with your transaction ID and description.
- For larger needs (over 200 participants) contact [**hello@once.film**](mailto:hello@once.film) for custom pricing.
- Camera is used only when you take a photo. Photo library is used only when you select a photo. Permissions are required by your device OS.
- Push notifications are optional and can be managed in your device or app settings.
- You are responsible for your mobile data and carrier charges.
Ownership
You own the photos you upload.
License to Once.
To operate the Service, you grant Once a worldwide, royalty‑free license to host, process, transmit, display, and back up your photos and film data as needed to run the Service.
Film Hosts.
If you create a film:
- You control access via invite links or codes and can set visibility, participant limits, and reveal time.
- You get a non‑exclusive license to use photos uploaded into your film **only for running, viewing, sharing, and exporting that film for personal, event, or internal purposes**. Any commercial use requires permission from the uploader.
Participants.
If you join another user’s film:
- You keep ownership of your photos.
- You grant the Film Host the limited license described above.
- Your photos may be visible to other participants based on the film’s settings.
Do not upload content you do not have the right to share. We may remove content or suspend accounts that violate these Terms or the law.
Not a backup service. Keep your own copies of important photos.
Do not:
- Break the law, violate others’ rights, or upload unlawful, infringing, harassing, hateful, pornographic, or excessively violent content.
- Upload others’ photos without permission.
- Attempt to reverse engineer, interfere with, disrupt, or overload the Service.
- Use bots, scrapers, or unauthorized automation. - Impersonate someone or misrepresent your affiliation.
We use vendors such as Supabase (database, auth, storage), RevenueCat (purchases), PostHog (analytics/session replay), and Vercel (hosting). Their services are provided under their own terms. We are not responsible for third‑party websites or materials.
Apple.
These Terms are between you and Once, not Apple. Apple is not responsible for the app. Apple has no duty to provide support. If the iOS app fails to conform to any warranty, you may notify Apple for a refund of the app price, if any. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.
Google.
These Terms are between you and Once, not Google. Your use of the Android app must follow Google Play policies. Google is a third‑party beneficiary of these Terms and may enforce them.
Apple’s standard EULA.
For iOS downloads, Apple’s Licensed Application End User License Agreement (LAEULA) applies. If there is a conflict, the LAEULA controls to the extent required by Apple.
If you believe content on the Service infringes your copyright, email hello@once.film with a DMCA notice that includes: (1) your contact info, (2) the work claimed infringed, (3) the specific URL or location of the material, (4) a good‑faith statement that the use is not authorized, (5) a statement under penalty of perjury that your notice is accurate and you are the owner or authorized agent, and (6) your physical or electronic signature. We may terminate repeat infringers.
The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. Some regions do not allow disclaimers; you may have rights that cannot be waived.
To the extent not prohibited by law: (a) we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; and (b) our total liability for any claim is limited to the amount you paid to Once for the Service in the 6 months before the claim. These limits apply even if a remedy fails its essential purpose.
You will defend and hold Once harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, or your violation of these Terms or the law.
You may stop using the Service at any time. We may suspend or terminate your access, or remove content, if we believe you violated these Terms or the law. Sections that by their nature should survive termination do survive.
We may update these Terms. If we make material changes, we will notify you in‑app or by email. Continued use means you accept the new Terms.
Governing law. Delaware law governs these Terms, without regard to conflict‑of‑laws rules. The Federal Arbitration Act (FAA) governs the arbitration agreement below.
Informal resolution. Before filing a claim, you and Once will try to resolve it informally. Email hello@once.film with “Dispute” in the subject. If not resolved in 30 days, either party may file.
Arbitration. Any dispute relating to the Service will be resolved by binding individual arbitration administered by JAMS under its rules, before one arbitrator. Hearings may be held by video/phone or, at your choice if you are a U.S. consumer, in your county of residence. Judgment may be entered in any court with jurisdiction.
Exceptions. (a) Small‑claims cases may proceed in small‑claims court in your county of residence or New Castle County, Delaware. (b) Claims seeking only public injunctive relief, and (c) intellectual‑property disputes, may proceed in court.
Class waiver. No class actions or class arbitrations. The arbitrator may not consolidate claims.
Opt‑out. You may opt out of arbitration and the class waiver by emailing hello@once.film within 30 days of first accepting these Terms, stating your name, account email, and a clear request to opt out. If you opt out, neither you nor Once will be bound by this Section for future disputes.
Export. You must comply with U.S. export laws and may not use the app in embargoed countries or by prohibited parties.
Severability. If a term is unenforceable, the rest remain in effect.
Assignment. We may assign these Terms. You may not assign without our consent.
No waiver. A failure to enforce a term is not a waiver.
